Product Warranty Policy

1. Coverage

McElhill Engineering Ltd warrants that all our products and attachments manufactured by us, including saw heads, tree shears, timber grabs, flail heads, and saw head blades, but not exclusive to, are free from defects in material and workmanship under normal use and service.

This warranty applies to the original purchaser only and is non-transferable.
⚠️ If the Product is sold or transferred to another party, the warranty will not extend to the new owner.


2. Warranty Period

  • Main structural components (frames, arms, housings): 12 months from the date of delivery.
  • Hydraulic components (cylinders, motors, valves,): 6 months from the date of delivery.
  • Wear parts (blades, cutting edges, bearings, seals, flails, etc.): Not covered under warranty, as these are consumable items subject to normal wear and tear.

The standard warranty period is 12 months from the earlier of:
(a) the date the Product is delivered to the customer, or
(b) the date the Product is collected by the customer or their representative.

This warranty applies only to the original purchaser and is not transferable if the product is sold or otherwise passed to a third party.

Warranty periods begin from the date of delivery / collection, regardless of the date of installation or first use.


 

3. Conditions of Warranty

This warranty is valid only if:

  1. The Product is installed, operated, and maintained in accordance with the instructions provided by McElhill Engineering Ltd.
  2. All servicing and repairs are carried out by qualified personnel, using genuine McElhill Engineering Ltd parts.
  3. The Product has not been altered, modified, or repaired without prior written consent from McElhill Engineering Ltd.
  4. The customer has complied with all maintenance requirements, including greasing, hydraulic oil checks, blade/flail replacement, torque inspections, and other routine care. Maintenance logs must be complete and up to date.
  5. Operator Sign-Off Requirement: The operator sign-off sheet contained in the Product manual must be completed and signed before the product is put into use. This confirms that the operator has read and understood the operating instructions, safety guidelines, training, and maintenance requirements.

⚠️ Failure to complete this sign-off sheet will render the warranty void.

  1. Return Authorisation Requirement: Customers must not return any Product or component without prior written authorisation. A written request for return must first be submitted to mcelhillengineeringltd@hotmail.com, stating the reason for return. Only after written authorisation may the item be shipped back.

7.      Shipping Fee Responsibility: Customers are responsible for covering the shipping costs for returning items. We recommend using a trackable shipping service or purchasing shipping insurance, as we cannot guarantee receipt of returned items. 

⚠️ Unauthorised returns will not be accepted. All costs for shipping, handling, inspection, or disposal of unauthorised returns will remain the responsibility of the customer.


4. Exclusions

This warranty does not cover:

  • Normal wear and tear of consumable components (including, but not limited to, blades, flails, grab tines, pins, bushes, seals, and bearings).
  • Failures caused by misuse, abuse, negligence, or operation outside the Product’s rated capacity or specifications, including (but not limited to):
    • Using the equipment on materials larger than the rated cutting or lifting capacity.
    • Operating on machines with incorrect hydraulic pressure or flow.
    • Modifying or welding structural components.
    • Operating without protective guards, safety devices, or correct set-up.
  • Damage caused by operator error, collision, or impact with foreign objects.
  • Failures caused by improper installation, lack of maintenance, or hydraulic contamination.
  • Products altered or repaired with non-genuine parts or by unauthorized personnel.
  • Costs of routine maintenance (e.g., blade sharpening, flail replacement, lubrication).
  • Damage caused by external events including fire, flood, theft, vandalism, accidents, or natural disasters.
  • Transport, shipping, travel, and accommodation costs associated with repairs or inspections, unless a valid manufacturing defect is confirmed.
  • Any indirect, incidental, or consequential losses, including but not limited to lost time, lost revenue, or loss of contracts.

5. Remedies

If a Product is found to be defective within the warranty period:

  • McElhill Engineering Ltd will, at its sole discretion, repair or replace the defective component.
  • Where appropriate, repair or replacement under warranty may take precedence over refund (see Refund Policy, section 8).
  • The Company’s liability is limited strictly to the cost of repair or replacement of the defective part only.
  • If no defect is found, inspection and travel costs will be chargeable to the customer. Customer pre-approval of such costs may be required before inspections take place.

6. Customer Responsibilities

To make a warranty claim, the customer must:

  1. Notify McElhill Engineering Ltd in writing to mcelhillengineeringltd@hotmail.com within 7 days of the defect being discovered.
  2. Provide proof of purchase, product serial number(s), and detailed information regarding the defect.
  3. Provide photos or videos of the defect before shipping any part or machine.
  4. If requested, return the defective component or Product only after written authorisation is received.
  5. Ensure the item is securely packaged to prevent further damage. Any transit damage due to poor packaging will void coverage.

Photo/Video Evidence Requirement

  1. Customers must provide clear photographic and/or video evidence of the claimed defect, fault, or damage as part of the initial request for warranty service or refund.
  2. Such evidence must be submitted at the same time as the first written request, or within 24 hours of that request at the latest. Claims without the required evidence may be considered incomplete and therefore ineligible for processing.
  3. The images/videos must clearly show:
    1. The machine or product in question,
    2. The specific defect, fault, or damage being claimed, and the product’s overall condition (to verify against misuse, alteration, or accidental damage).
    3. Customers must provide details (photos / video evidence) of the operating conditions at the time of failure, including the type, size, and material being processed. This information is required to confirm that the Product was being used within its intended design limits and not subjected to excessive force, oversized timber, or unsuitable materials.
  4. McElhill Engineering Ltd reserves the right to reject or delay any warranty or refund claim until sufficient photographic/video evidence has been provided.

7. Relationship to Refund Policy

  • Refunds are generally not provided for defective items; instead, the Company will repair or replace under warranty terms.
  • Custom-engineered or non-standard items are not eligible for refund under either this warranty or the Refund Policy.
  • Where overlap occurs, the Refund Policy takes precedence for return/refund procedures, and this Warranty Policy takes precedence for defects and repairs.
  • In all cases, misuse, improper installation, or customer-caused damage voids both warranty coverage and refund eligibility.

8. Legal Compliance & Limitations

  • This warranty is provided in accordance with UK consumer and contract law. Nothing in this warranty limits or excludes any statutory rights which cannot be lawfully excluded.
  • The maximum liability of McElhill Engineering Ltd under this warranty shall not exceed the original purchase price of the Product.
  • Once the Product has been delivered to the customer’s premises, designated delivery location, or collected directly by the customer (or their appointed agent), all risk of loss, damage, or theft passes immediately to the customer.
  • No representative, dealer, or distributor is authorized to alter, modify, or extend this warranty on behalf of McElhill Engineering Ltd. Any amendments or exceptions must be made in writing and formally authorised by a Director of McElhill Engineering Ltd.
  • The English version of this policy is the legally binding version in all cases.
  • Compliance with Law - Nothing in this Refund Policy limits or excludes any rights that customers may have under mandatory consumer protection laws of Northern Ireland and the United Kingdom, where applicable. However, to the fullest extent permitted by law, all additional rights, remedies, or implied terms are excluded.

9. Governing Law

This warranty shall be governed by and construed in accordance with the laws of Northern Ireland and the United Kingdom, and any disputes shall be subject to the exclusive jurisdiction of the courts nearest to McElhill Engineering Ltd’s registered office based at 28 Tiravally Road, Mackan, Enniskillen, Co. Fermanagh, N. Ireland, BT92 3EP.


10. Policy Updates

McElhill Engineering Ltd reserves the right to revise and update this warranty policy periodically to reflect changes in law, business practices, or customer protections.


11. Acceptance of Terms

By purchasing, accepting delivery, or collecting a Product, the customer confirms their acceptance of this warranty policy in full.
