Return and Refund Policy

1. Eligibility for Return and Refund
To qualify for a return and refund, the following requirements must be met:

Return Period: All return requests must be initiated in writing to mcelhillengineeringltd@hotmail.com within 30 days from the earlier of:
(a) the date the Product is delivered to the customer, or
(b) the date the Product is collected by the customer or their representative. After this period, only warranty service applies. - Condition of Items: Products must be returned in fully operational condition with no excessive wear, damage, or modifications.
- Proof of Purchase: A valid proof of purchase, such as a receipt or order confirmation, is required.
- Original Purchaser Only: Refunds and returns are available only to the original purchaser. If the Product is sold or transferred, the new owner is not eligible for any refund or return.
- Written Request for Return: Customers must first submit a written request to mcelhillengineeringltd@hotmail.com explaining the reason. Only after McElhill Engineering Ltd reviews and provides written authorisation may the item be shipped back.
- ⚠️ Unauthorised returns will not be accepted, and associated costs (shipping, handling, disposal) remain the customer’s responsibility.
2. Photo/Video Evidence Requirement
- Customers must provide clear photographic and/or video evidence of the claimed defect, fault, or damage as part of the initial request for warranty service or refund.
- Such evidence must be submitted at the same time as the first written request, or within 24 hours of that request at the latest. Claims without the required evidence may be considered incomplete and therefore ineligible for processing.
- The images/videos must clearly show:
- The machine or product in question,
- The specific defect, fault, or damage being claimed, the product’s overall condition (to verify against misuse, alteration, or accidental damage).
- Customers must provide details (photo / video evidence) of the operating conditions at the time of failure, including the type, size, and material being processed. This information is required to confirm that the Product was being used within its intended design limits and not subjected to excessive force, oversized timber, or unsuitable materials.
- McElhill Engineering Ltd reserves the right to reject or delay any warranty or refund claim until sufficient photographic/video evidence has been provided.
3. Non-Refundable Items
- Custom-engineered machinery or non-standard items.
- Modified standard products or special-order parts.
- Any item where design and production has already commenced.
Examples of non-refundable items include, but are not limited to:
· - Bespoke Machinery: Equipment uniquely designed to meet specific customer specifications.
· - Modified Standard Products: Standard products that have been customised or altered.
· - Special Orders or Non-Standard Parts: Parts or components that are not regularly stocked and have been sourced or manufactured on a one-off basis.
Important Note: Custom-engineered items cannot be returned or refunded once the design and production processes have started. Please review all specifications and requirements before confirming your order.
4. Inspection Fees for Non-Eligible Returns
· If a returned item does not meet eligibility requirements, an inspection fee may apply to cover labour and handling costs. This fee will be deducted from any potential refund or, if no refund is available, billed to the customer. (10% of the original purchase price to cover handling and processing costs)
· Refunds are not available for items that have been partially used, damaged, or modified by the customer. Such items are considered ineligible for refund /return as they cannot be resold or reconditioned.
5. Return Shipping Costs & Responsibility
· Customers are responsible for covering the shipping costs for returning items. We recommend using a trackable shipping service or purchasing shipping insurance, as we cannot guarantee receipt of returned items.
- Products must be securely packaged (crates, pallets, padding). Any damage caused during return transit due to poor packaging voids eligibility.
- International returns: customer is responsible for all duties, taxes, and fees.
6. Inspection and Restocking
- Inspection of Returns: All returned products will be inspected by McElhill Engineering Ltd to ensure they meet the eligibility criteria outlined in this policy.
- Restocking Fee:
- A restocking fee of up to 20% of the original purchase price may be applied to standard products returned in good condition and within the eligible return period.
- The restocking fee covers:
- Inspection and handling of the returned product.
- Cleaning, minor refurbishment, or repackaging required to resell the product.
- Administrative processing costs.
- Loss of resale value due to the item no longer being “brand new.”
⚠️ Important: Restocking fees do not apply to items returned due to a confirmed defect under warranty.
- Refund Calculation:
- Refund = Original Purchase Price − Restocking Fee (if applicable)
- Example: Standard machine purchased for £1,000; 20% restocking fee applied → Refund = £800
- Non-Eligibility:
- Products returned in a damaged, modified, or improperly packaged condition may have additional costs deducted or may be deemed ineligible for a refund.
If the product does not meet eligibility criteria, the customer is responsible for costs of shipping the item back or disposal after 30 days.
7. Refund Process
Refund Process:
- Return Inspection: Once we receive your returned item, our team will inspect it to confirm eligibility for a refund.
- Notification: We will send you an email to notify you that we have received your return. This email will also inform you whether your refund has been approved or rejected.
- Processing Time: If approved, your refund will be processed, and the amount will be credited back to your original payment method within 5-7 business days. Please note that the time it takes for the credit to appear on your account may vary depending on your bank or payment provider. Payment will only be credited to the original payment method.
- Rejection of Refund: If your return does not meet the eligibility criteria, we will explain the reasons for the rejection in writing and may offer options for resolution.
8. Warranty vs. Refund
- Defective items are covered under the Warranty Policy. Repair or replacement may take precedence over refund.
- Refunds will not be issued for misuse, improper installation, or operator error.
9. Additional Terms
- Refunds not available for items partially used, damaged, or modified by the customer.
- Refunds or warranty service are only available where the operator sign-off sheet has been completed.
- Customers must provide photos/videos of any defect before shipping returns.
- No consequential, incidental, or indirect costs (including downtime or lost contracts) are refundable.
- The English version of this policy is legally binding. No verbal or implied agreements override this policy.
10. Legal Compliance & Limitations
Governing Language - This Refund Policy is drafted in the English language, and the English version shall prevail in the event of any conflict, inconsistency, or translation. If the policy is translated into another language for convenience, the English version will remain the legally binding version.
Entire Agreement – No Verbal or Implied Representations
This Refund Policy (together with McElhill Engineering Ltd’s Terms & Conditions, Warranty Policy, and any written sales contracts) represents the entire agreement between McElhill Engineering Ltd and the customer regarding refunds, returns, and related obligations.
No verbal promises, informal assurances, or representations by any employee, agent, or reseller shall override or alter the terms contained in this written policy. Customers cannot rely on any statements made outside of this written agreement.
Any amendments or exceptions must be made in writing and formally authorised by a Director of McElhill Engineering Ltd.
Compliance with Law - Nothing in this Refund Policy limits or excludes any rights that customers may have under mandatory consumer protection laws of Northern Ireland and the United Kingdom, where applicable. However, to the fullest extent permitted by law, all additional rights, remedies, or implied terms are excluded.
11. Governing Law & Jurisdiction
This Refund Policy is governed by the laws of Northern Ireland and the United Kingdom.
Any disputes arising from this policy shall be subject to the exclusive jurisdiction of the courts nearest to McElhill Engineering Ltd’s office at 28 Tiravally Road, Mackan, Enniskillen, Co. Fermanagh, BT92 3EP.
12. Policy Updates
McElhill Engineering Ltd reserves the right to revise and update this Warranty Policy periodically to reflect changes in law, business practices, or customer protections.
13. Acceptance of Terms
By purchasing, accepting delivery, or collecting a product, the customer confirms their acceptance of this Warranty Policy in full.
